SAN FRANCISCO — The Ninth Circuit revived the Navajo Nation’s breach of trust claim alleging that the federal government failed to consider “as-yet-undetermined water rights in managing the Colorado River,” finding that dismissal was improper as the Nation’s attempts to amend its complaint were not futile.
