IMMUNITY, TRIBAL LAW - Foxworthy, who drove on the Puyallup reservation and was hit by a drunk driver, sued the driver and the Puyallup Tribe of Indians Association for serving the driver too much alcohol in violation of the state's Dram Shop Act. J. Hunt dismissed the action against the tribal association because the tribe has not waived sovereign immunity to private lawsuits in state court, and Congress has not chosen to abrogate tribal immunity in private dram-shop actions. Affirmed. Foxworthy v. Puyallup Tribe of Indians Association.
