VANCOUVER, B.C. (CN) - Warner Bros. has sued the Wyrd Sisters, claiming the Canadian folk band owes it $140,000 in legal costs for unsuccessfully trying to block the release of the movie "Harry Potter and the Goblet of Fire." The band, through lead singer Kim Baryluk, sued Warner in 2005, seeking to restrain the studio from using the band name "The Weird Sisters" in the Harry Potter film.
The fictional band included members of Radiohead and Pulp, but the Ontario Superior Court disagreed with the claim that Baryluk's band would be harmed by the film's release.
"Three female folk singers from Manitoba are in my view not likely to be confused with the fictional characters from a novel portrayed in a movie by three recognizable British rock stars," the court ruled.
In its lawsuit, Warner Bros. says the Ontario court ordered the Wyrd Sisters to pay its $140,000 in legal costs.
The Wyrd Sisters' original suit demanded $40 million in damages.
