NEW ORLEANS — The Fifth Circuit revived false-arrest claims brought by individuals who were arrested and indicted after a deadly shootout at a Twin Peaks restaurant in Waco, Texas, in 2015. The lower court ruled the grand jury’s indictments broke the chain of causation for the false arrest claims stemming from a form warrant affidavit, but the plaintiffs argue the “grand jury was misled," as was the magistrate judge who issued the arrest warrants.
