W.Va. Appeals Court

CIVIL PROCEDURE - The West Virginia Supreme Court finds that the trial court properly permitted a water treatment worker to intervene in an action for strict liability brought by coal preparation plant workers that have been exposed to polyacrylamide.

There are common facts to both water plant and coal preparation workers, such as exposure to the same chemical and the question of risk of contracting the same diseases, which make intervention proper. SER Chemtall Inc. v. Judge Madden
