Vizio Scores Partial Win in DTV Patent Dispute

(CN) - Amtran Technology's "work-around" Vizio digital television products do not infringe on a patent held by Japan's Funai Electric Co., the Federal Circuit ruled. The ruling reverses an order barring Amtran from importing its Vizio brand TVs to the United States.

The U.S. International Trade Commission ruled in April 2009 that Amtran's "work-around" products, referring to its recently redesigned digital TVs, violated Funai's patent.

Funai had sued 14 companies, including Amtran, for patent infringement.

The federal appeals court in Washington, D.C., ruled for Funai on the original Vizio models -- the so-called "legacy" products -- but concluded that Amtran's work-around products do not infringe Funai's patent.

In a partial dissent, Judge Raymond Clevenger said he would have affirmed the ITC's ruling entirely, including the finding of infringement for the work-around products.
