Video-Game Creator Sues Over ‘Damnation’

BALTIMORE (CN) - Blue Omega Entertainment was forced to absorb the costs of Velvetelvis Studios' lack of resources and unprofessional work on its upcoming video game, "Damnation," according to a lawsuit in Federal Court. The Beverly Hills-based studio "repeatedly missed milestone deliverable dates," the suit claims, including its deadline for "final delivery of all scenes."

As the game's creator, Blue Omega hired Velvetelvis to help develop "Damnation" for Microsoft's Xbox 360 and Sony's PlayStation3.

"In addition, it was often apparent that (Velvetelvis') work was not being performed 'using sound, professional practices and in a competent and professional manner,'" the complaint states. Blue Omega says the defendant didn't have the production resources to fulfill its contract.

"(Velvetelvis') failure forced Blue Omega to divert resources, incur costs, and retain another contractor - all in an effort to complete and remedy the unfinished and unacceptable work product provided by (Velvetelvis)," the complaint states.

Blue Omega demands more than $75,000, plus legal costs.
