SALT LAKE CITY (CN) - A man who was shot three times in the Trolley Square shopping mall massacre that left nine people dead or wounded has sued the pawnshop that sold the pistol-grip shotgun to the underage shooter. The gunman shot Stacy Hanson twice with a shotgun, then shot him a third time as Hanson lay wounded after police gunfire drove the shooter back into the store.
Stacy Hanson sued Sportsman's Fast Cash, a West Valley pawn shop, and Westley Wayne Hill, its licensed firearms dealer. Hanson says the defendants illegally sold a Maverick Arms model 88 12-gauge pistol-grip shotgun to Sulejman Talovic on Nov. 13, 2006.
Talovic shot and killed or wounded nine people at Trolley Square shopping mall on Feb. 12, 2007, before he was killed by police.
Hanson says Talovic shot him twice with the pistol-grip shotgun inside the Cabin Fever store. As he lay wounded in the abdomen and arm, Talovic left the store but was driven back by police gunfire, Hanson says. Talovic then shot him again in the back as he lay on the ground.
Talovic was 18 when he bought the shotgun from the defendants, and sale of pistol-grip shotguns is prohibited to people younger than 21 under the Federal Gun Control Act, the complaint states.
Also, Talovic was a resident alien, which Hill and Sportsman's failed to record on the ATF form; nor did they get the two pieces of ID required because Talovic was a resident alien, the complaint states.
Hanson and his wife demand punitive damages for gross negligence and loss of consortium. They are represented in Salt Lake County Court by Benjamin Lieberman with Burbidge, Mitchell & Gross.
