NEW ORLEANS — The Fifth Circuit upheld an ordinance in Dallas, Texas, that requires licensed sexually oriented businesses such as cabarets and adult video stores to close between 2 and 6 a.m. The lower court believed the city’s evidence was not reliable, but the appellate court finds that ample data from the city’s police, other comparable cities and academic research supports a link between these businesses’ late-night operation and heightened crime.
