HAGATNA, Guam — A federal judge in Guam dismissed the Holy See from a former student’s complaint alleging he was sexually assaulted by the archbishop of Hagatna, Guam. The Holy See, as a foreign state, was not properly served and the court lacks both personal and subject matter jurisdiction over it. The Vatican is not liable for the archbishop’s actions because, per case law, the assaults “fell outside the scope of [his] employment with the Holy See.”
