Vanderbilt Rape Trial Pushed to January

NASHVILLE (CN) - The rape trial of former Vanderbilt University football players will resume in January after an injury sidelined a defense attorney, a judge said today.

Brandon Vandenburg, 21, and Cory Batey, 20, were to stand trial this week on five counts of aggravated rape and two counts of aggravated sexual battery.

Two other former Vanderbilt Commodores - Brandon Banks and Jaborian "Tip" McKenzie - also face such charges on the alleged June 23, 2013, dorm room rape of an unconscious female student. Their trial has not yet been scheduled.

Vandenburg, who was living in the Gillette House dorm room where the alleged attack occurred, also faces one count of tempering with evidence and one count of unlawful photography.

Jury selection was delayed Monday morning because Batey's attorney, Worrick Robinson, tore his bicep and underwent an MRI.

Judge Monte Watkins pushed proceedings to early next year because of Robinson's surgery, scheduled for next week, according to a Tennessean report.

Court records show the trial tentatively scheduled for Jan. 12, 2015.
