TOPEKA, Kan. (CN) - A university had no duty to warn students that climbing out of a seventh-story window was dangerous and potentially deadly, the Kansas Court of Appeals ruled.
John and Donna Wellhausen sued the University of Kansas after their son, Eric, died after fall out the window of his dormitory.
Eric had been drinking when he attempted to drop from his window to a 2-foot ledge several feet below.
Judge Caplinger found the trial court properly granted summary judgment to the university.
"A university is not an insurer of the safety of its students," Caplinger ruled. "Hence, a university has no obligation to protect its students from their own reckless and negligent acts."
