Universal Musica Allegedly Sabotaged ‘Baby Boy’ Contract

MIAMI (CN) - Universal Musica and its senior vice president violated an acquisition agreement with Guitian Brothers Music by destroying the relationship Guitian had with Spanish-language singer Baby Boy, Guitian claims in Miami-Dade County Court.

According to the complaint, Oscar Guitian and his company agreed to scout talent for Universal, identifying and introducing Spanish-language songwriters to the record label. The plaintiff allegedly found singer-songwriter Baby Boy, whose real name is Roberto Barrero Jr., and arranged a meeting with Universal. Universal signed the artist to an exclusive contract, the lawsuit claims.

Guitian claims that after Baby Boy released his first album, "Ya No Llores: Let Me Love You," Universal's senior vice president, Eddie Fernandez, tried to destroy the relationship between the artist and plaintiffs by repeatedly claiming that Baby Boy was upset with Guitian and no longer trusted him, and that the artist wanted out of the contract.

The plaintiffs say they reluctantly agreed to release Baby Boy and had Universal prepare the release document. But they claim the "release" form was actually an amendment to his contract that removed the plaintiffs from the deal, but left the agreement in tact for Universal and Baby Boy.

The plaintiffs also allegedly discovered that Universal had paid Baby Boy a $50,000 advance, which created the appearance of preferential treatment for other artists brought in to the joint acquisition agreement.

Guitian and Guitian Brothers Music are suing for alleged breach of contract, fraud and breach of fiduciary duty.
