(CN) - The United Way claims a marketer and event manager owes it more than $58,000 from a fund raiser featuring Pete Sampras, who is not a party to the lawsuit.
The United Way of Metropolitan Atlanta sued Prolink Sports and Entertainment, two Prolink affiliates, and Timothy M. Stallard and Trevor Hance, in Travis County Court, Austin, Texas, where all the defendants are based.
The United Way claims it signed an agreement with Stallard, who agreed to provide event management and marketing services, for the November 2009 fund raiser.
United Way says it paid Stallard and Prolink a consulting fee for their services.
"Defendant Stallard collected the revenue derived from online ticket sales to the event, but he failed to remit at least $58,763,45 to United Way," the complaint states. "Defendant Stallard has admitted that this debt is owed to United Way, yet despite repeated demands for payment, and despite repeated assurances that payment would be forthcoming, the debt has not been paid to United Way."
Prolink's right to do business as a corporation was forfeited in 2008 due to failure to pay franchise taxes, the complaint states. Stallard and Hance became Prolink directors in 2003. Since Prolink's actions occurred after its tax-related forfeiture, Stallard and Hance are liable for the debt according to Texas law, the United Way says.
It seeks damages for breach of contract. It is represented by Seth E. Meisel, with Streusand, Landon & Ozburn.
