PASADENA, Calif. (CN) — The Ninth Circuit asked the Board of Immigration Appeals to revisit the merits of claims by a transgender woman that she will face persecution if deported to Mexico.
Bibi Bibiano appealed in the Ninth Circuit, where her in absentia removal order originated, but the government wanted the case transferred to the 11th Circuit, where her reinstated removal order became final.
The Ninth Circuit said Friday that "transfer is not in the interests of justice," even if venue is not proper here, "given the unique circumstances of this case."
