PHILADELPHIA — The National Labor Relations Board “lost the forest through the trees” when it determined a facetious tweet by the executive officer of the company that operates The Federalist was a “true threat,” the Third Circuit ruled. Ben Domenech had tweeted at The Federalist, “first one of you tries to unionize I swear I’ll send you back to the salt mine.”
