A federal judge refused to dismiss a student class action against Brigham Young University seeking a refund of tuition fees after live, in-person instruction was canceled due to Covid-19.

SALT LAKE CITY — A federal judge refused to dismiss a student class action against Brigham Young University seeking a refund of tuition fees after live, in-person instruction was canceled due to Covid-19. The student sufficiently argued that live instruction was valuable and implied in his contract with the university and he did not receive that benefit. Students may still be entitled to a refund even if live instruction was impractical.
