Troubled Clinic Evicted, Dunned For Rent

LAS VEGAS (CN) - More legal troubles for the Endoscopy Center of Southern Nevada, the clinic accused of reusing syringes and potentially exposing 40,000 patients to HIV and hepatitis. Now the clinic is accused of failing to pay rent.

Gold Shadow Properties, which owns the medical office complex where the clinic has operated since 2004, says doctors violated the lease when they "created a health hazard," and were evicted from the property on March 15.

Doctors then stopped paying the $7,227.39 monthly rent, the lawsuit states in Clark County Court.

But the plaintiff says it hasn't been able to rent the space, and according to the lease, the clinic is liable for rent for the full term of the lease.

The lawsuit does not indicate how much rent is at stake, but since March 1, unpaid rent at $7,227.39 per month equals $36,136.95, and growing.

Nevada health officials sent about 40,000 letters to former patients, urging them to get tested for hepatitis B and C and HIV because doctors were accused of reusing syringes and single-dose vials of anesthesia.

The plaintiff is represented by Steven Marzullo.
