PHOENIX (CN) - Gilbert, Ariz., did not overstep its bounds by building a water pipeline through the middle of an all-male academy.

Queen Creek Summit LLC, which owns the land under Canyon State Academy, appealed after the trial court granted Gilbert an Application of Immediate Possession for the 13-mile pipeline.

J. Barker agreed with the trial court that Gilbert properly assessed the damages to the property and acted responsibly to minimize the effect on the academy.

"Gilbert went to great lengths to engage QCS in the process of choosing an alignment on its property," Barker said. "QCS failed to prove that Gilbert improperly balanced the 'greatest public good' and the 'least private injury.'"
