DENVER — The Tenth Circuit upheld a ruling against 21 individuals living near a timber project in the White River National Forest who claimed the Forest Service violated the National Environmental Policy Act and the Administrative Procedure Act when it granted final approval of the project. The plaintiffs did not adequately brief on appeal their claim that the Forest Service failed to consider the project’s effects on climate change and greenhouse gas emissions.
