SAN FRANCISCO — The Ninth Circuit ruled the dismissal of an indictment against Howard Weiss improper, saying a reasonable jury could find his Oct. 2, 2018, message to Senator Mitch McConnell was a “true threat and not entitled to First Amendment protection.”
