‘There’s the Hole in One; Where’s the Car?’

ANAHUAC, Texas (CN) - A Toyota dealer stiffed a golfer for a Camry it promised for a hole-in-one because he teed off from the senior's tee, the senior citizen claims in court.

Pat Baker sued Community RAE Automotive LLC dba Community Toyota, in Chambers County Court.

Community Toyota sponsored the Baytown Chamber of Commerce Golf Tournament at the Eagle Ford Golf Club in Mont Belvieu, Texas in April this year.

It offered a new Toyota Camry for any golfer who hit a hole-in-one on the par-3 eighth hole.

Baker, who is 65 or older, says he played the tournament from the green tees, designated for senior citizens.

"The tournament rules stated that 'men play from the blue tees, women play from the red tees and players 65+ play from the green tees' and that 'a hole-in-one on Hole #8 (par 3) wins a car," the complaint states. (Parentheses in complaint.)

Baker claims that when he nailed the hole-in-one a spotter congratulated him and called Community Toyota's agent Jim Wadzinski to confirm it.

"Unfortunately, Jim Wadzinski said words to the effect that 'No, Pat Baker did not win the prize because he teed off from the green markers,' although Wadzinski admitted a mistake was made because the green markers should have been placed farther back by the regular men's blue markers," the complaint states.

"Wadzinski felt bad about it but nevertheless Community Toyota did not honor its offer and refused to award Pat Baker the prize offered under the tournament rules announced."

Baker seeks damages for breach of contract.

He is represented by Richard Baker with Baker & Zbranek of Liberty.
