The Worst Boss in the World?

JERSEY CITY (CN) - A Family Dollar store fired two women for complaining that their boss watched porn and masturbated at work, had sex with workers on company time and stalked customers, the women claim in court.

Vivian Iguina and Zakiytah Crawford sued Family Dollar Stores and Martin R. Basilio in Hudson County Court. They say they worked for Basilio in the company's Bayonne, N.J. store.

"Basilio kept pornographic DVDs in the store and watched them on his laptop computer during store hours while he was supposed to be working. Basilio often went into his office or the restroom with the pornographic DVDs and tissue paper and masturbated," the complaint states.

It continues: "Every Friday a Chinese lady came into the store selling pornographic DVDs to Basilio. Basilio went into the office and watched them on his laptop computer. Basilio brought his laptop computer on the same days the Chinese woman delivered the pornographic DVDs to Basilio.

"Based on observations it was clear to plaintiff Iguina that Basilio was masturbating because she could hear him breathing heavily in the office. He would then exit his office disheveled, often with his zipper undone, and powder allover his pants.

"Basilio also ordered plaintiff Iguina to clean up the bathroom after he had been in there for a long period of time. There would be blood and semen."

Iguina claims that when she "complained to Basilio that it was wrong to have the pornography in the office, he scolded her to 'mind your own business' and 'it's none of your business.'"

The woman say repeatedly Basilio made rude, crude and offensive sexual comments, which they complained about to their district and regional managers.

The complaint adds: "Plaintiff Iguina repeatedly demanded Basilio on numerous occasions to stop the inappropriate sexual comments and behavior which included his touching female employees and stalking customers.

"On numerous occasions, plaintiff Iguina witnessed co-worker Amanda Rodriguez going into the back office with Basilio to have sex.

"Amanda told plaintiff Iguina that she reported Basilio to Bill, the district manager, and informed him that they were having sex for favors like paying her while she was"

"Ms. Rodriguez told plaintiff Iguina that Ms. Rodriguez's employment was terminated once she refused to continue having sex with Basilio."

Iguina claims she called her regional or district manager "on average every other day about for a month regarding Basilio's clearly improper comments and behavior," but the company took no remedial action.

She claims Family Dollar eventually fired her under the pretext that she missed work one day without calling in. She says she did call in that day, to say she had to stay home because of a gas leak.

Plaintiff Crawford claims Basilio harassed her with graphic, offensive sexual comments, and assaulted her.

In May 2012, she says, "Basilio physically assaulted plaintiff Crawford. Plaintiff Crawford was in the back office counting money. When she went to leave the office Basilio came behind her, pinned her to the wall, and choked her from behind. He asked her 'Do you like that?' She said, 'No, I don't like this.' He then stated he 'was sorry.' The incident left plaintiff Crawford shaken and fearful.

"The day after that incident, Basilio reduced plaintiff Crawford's hours by half. He stated to her, 'I hope you don't think it was because of yesterday.' Plaintiff Crawford responded by asking. 'then what was it for?'

"On another occasion while Plaintiff Crawford was bending over, Basilio stated, 'what I would do to get in there.'

"Plaintiff reported the above described assault and the improper sexual harassment as well as the hostile work environment created by Basilio's non-stop sexual talk.

"After reporting the acts of sexual harassment and assault, plaintiff Crawford was interviewed, in May 2012, by Regional Loss Prevention Director, Dereck Cole. The complaint was written and the interview was recorded. During the taping, by Mr. Cole, Basilio continually walked in and out of the room. Basilio did not speak to plaintiff Crawford for 2 weeks after Mr. Cole interviewed her and plaintiff Iguina."

Crawford says she was fired in December 2012.

Both women seek punitive damages for sexual harassment, hostile work environment, wrongful termination, emotional distress, retaliation and negligent hiring.
