Texas city can’t ban weed arrests

AUSTIN — A Texas city’s ordinance banning law enforcement officers from making arrests and issuing citations for misdemeanor marijuana possession is preempted by state law, the Texas Court of Appeals ruled, issuing a temporary injunction prohibiting the enforcement of the ordinance. More than 81% of San Marcos voters approved of the proposition behind the ordinance in the November 2022 election.
