Tenth Circuit

IMMUNITY, INSURANCE - An insurance company brought suit against an insured, the Grand River Dam Authority, for damages related to a series of flood incidents which began in 1992. The 10th Circuit found that the insurance company's case originated in federal court and the GRDA never had the opportunity to seek a federal forum. Thus the lower court properly granted sovereign immunity. See ruling.
