Tenth Circuit Tosses Challenge To Utah Ban On Polygamy

DENVER (CN) - The 10th Circuit rejected the constitutional claims of Utah polygamists who were denied a marriage license by a county clerk.

J. Bronson, G. Cook and D. Cook claimed Salt Lake County Clerk Sherrie Swensen violated their rights under the First and 14th Amendments by refusing to let G. Cook marry a second wife, Bronson. They challenged the civil and criminal prohibition of polygamy in Utah. The circuit held that the plaintiffs forfeited their civil claims and lack standing to pursue their claims against Swensen based on the state's criminal ban on plural marriage. See ruling in .
