CONTRACT - A baby-formula manufacturer agreed to provide formula to retailers under the federally funded Women, Infants and Children program, and give the state cash rebates for each can it furnished. The manufacturer sought a $1.2 million refund, claimingit reduced the size of its formula cans, but the state refused to reduce the rebate. J. Cottrell upheld judgment for the state,saying theinvitation to bid for the contract never mentioned can size. See ruling.
