Teacher Tied Up 1st Grader, Dad Says

SAN DIEGO (CN) - After a special ed teacher at Sycamore Canyon Elementary School tied a first-grader to a chair and humiliated him by making him sit tied up in front of the classroom for an extended period, the Santee Unified School District promised, but failed to give the kid psychological counseling for trauma from this, from which he still suffers, the boy's father claims in Superior Court.

James Murphy demands punitive damages for assault and battery, false imprisonment, intentional infliction of emotional distress and negligence.

He claims the same teacher later punished his son for "taking too long to pack up his things" by telling him he would have to stay all alone in the classroom, then turning out the lights and closing the door, on a Friday afternoon - making the kid fear he would be abandoned for the weekend.

Murphy says school officials were far from forthcoming in responding to his complaints, and that his son suffers from post-traumatic stress syndrome and is scared to be left alone now, even to go to the bathroom.

He is represented by Brictson & Cohen.
