AUSTIN (CN) - A mother claims a teacher "forced a towel into the throat" of her 5-daughter to stop her from crying. She says her daughter was crying because the teacher had refused to let her go to the bathroom and the little girl wet herself.
The mother, Mariann Bedford, sued Oak Springs Elementary teacher Janis Day and the Austin Independent School District in Travis County Court.
The mother says, "Defendant Janis Day admitted during a meeting - a meeting attended by plaintiff - that she did lose control and forced a towel into the throat of the child."
She seeks punitive damages for constitutional violations, negligence, assault and intentional infliction of emotional distress.
She is represented by Solomon Bedford.
