HOT SPRINGS, Ark. — An Arkansas prison guard will have to face civil rights claims brought by a Black prisoner who says the officer had his hand on his gun when he said, “I heard Black people can run fast, so take off so I can shoot you!” Because the guard’s statement, at minimum, was made with deliberate indifference to the prisoner’s health and safety, he is not entitled to sovereign immunity as a matter of law.
