The Seventh Circuit stayed an injunction that had required Indiana to count all absentee ballots received by Nov. 13, finding the state’s law requiring all ballots to be received by noon on Election Day is “rational.” The circuit court added that the Supreme Court “insists the federal judges not change electoral rules close to an election.”

Ballot Access

The Sixth Circuit denied Michigan Governor Gretchen Whitmer’s request for a stay pending appeal of a case relating to ballot signature requirements. Proponents of a criminal justice reform initiative say the combination of the governor’s stay-at-home order and the signature requirements create an unconstitutionally severe restriction on their access to the ballot.
