Immigrant’s Arrest

A federal court in New York ruled that a Mexican immigrant may pursue his false arrest and Equal Protection claims against police officers who arrested him during a traffic stop. The immigrant was a passenger in the stopped vehicle, and at the time of the arrest, none of the officers had any evidence of the plaintiff’s immigration status, they only knew that he primarily spoke Spanish and “appeared Hispanic.”

Credible Fear Interview

A federal court in Texas ruled that it lacks jurisdiction to hear an Angolan man’s challenges to his expedited order of removal. The asylum seeker, who was beaten by police and military in his home country because of his father’s political ties, did not understand the translator during his credible fear interview because she did not speak the dialect of Portuguese he does.
