T-Mobile Forces Customers To Pay |For Text Messages, Lawsuit Claims

SEATTLE (CN) - T-Mobile USA fails to tell wireless customers that text messaging is a mandatory extra feature because they are automatically charged for messages sent to their phones, a class action claims in Federal Court.

T-Mobile customers claim they did not pay extra money for text-messaging service, but the phone company charges them anyway for unwanted text messages. Plaintiffs say they are unable to dodge the fees by refusing to open or respond to the messages, and T-Mobile charges them a $200 early termination to terminate their cell phone service.

They seek a permanent injunction, restitution and punitive damages. Plaintiffs are represented by Hagens Berman Sobol Shapiro LLP. See complaint.
