EL PASO, Texas — An appeals court in Texas ruled it lacked jurisdiction over a Houston swingers club’s claims that the state comptroller cannot use evidence obtained by investigators who secretly videotaped club members engaging in sexual activity in order to classify it as a sexually oriented business. The court ruled the “crux” of the appeal is a “contingent” decision by the comptroller and a “hypothetical injury that has yet to occur.”
