Studios Want Ring Tone Site Shut Down

LOS ANGELES (CN) - Fourteen major recording companies claim a ringtone company has stolen their music and let Internet browsers download it "tens of millions" of times, usurping their copyright and enriching itself. The studios claim defendant Myxer, fka mVisible Technologies, brags on its Web site of its "tens of millions" of copyright violations, "the Internet's larges collection of ringtones."

Myxer advertises that "Almost all of the content is free, as we're advertising supported," the federal complaint states. Its Web site claims that as of June 11, "9.9 million users have downloaded 114.8 million pieces of content to their mobile devices from our catalog of 404,439 items," the complaint states. It adds: "A large proportion of those 404-439 'items' were copyrighted material owned by others."

Myxer therefore violates copyright and induces others to violate copyright, and it profits by it, the complaint states.

Myxer is a Delaware corporation that operates out of Deerfield Beach, Fla.

The studios demand an injunction and damages. They are represented by Jeffrey Goldman with Loeb & Loeb.
