Student Says Sub Beat Him With Belt

ROCKVILLE, Md. (CN) - A substitute teacher pulled an elementary student's pants down in class and beat him with a belt while telling him "that she was going to 'kill him,'" the student and his mom claim in Montgomery County Court.

The mother, Tanya Dorsey, sued Montgomery County and Julia A. Resnik Elementary School principal Roy Settles Jr., alleging assault and negligent hiring.

The substitute, "whose name is believed to be Ms. Anderson," also pushed and slapped the child in the head, "with evil motive, actual malice, deliberate violence, and with the intent to injure" him, the family says.

The mother says principal Settles "should have known of the substitute teacher's inability to manage and/or control her anger and her aggression and her inability to properly supervise and/or control her students."

According to the complaint, the substitute "physically assaulted and battered minor K.G., by pushing, slapping minor K.G.'s head, pulling down his pants and swinging a belt at his legs and buttocks, and telling minor K.G. that she was going to 'kill him,' all of which caused minor K.G. physical and mental injuries."

The beating caused physical pain, suffering, distress, humiliation, mental anguish and anxiety, the mother says.

She seeks $200,000 in compensatory damages and $300,000 in punitive damages for infliction of emotional distress, assault, negligence and negligent hiring.
