Student Blames High School for Rape

CARLSBAD, N.M. (CN) - A student was forcibly raped in a high school bathroom despite her repeated complaints of sexual stalking and boys entering the girls room, she claims in court.

A.C. sued Carlsbad Municipal Schools, its Board of Education and four employees, including the superintendent, principal, an assistant principal and the teacher who supervised the bathroom where she was raped, in Eddy County Court.

A.C. claims that she and another girl repeatedly complained to school administrators of "highly inappropriate sexual advances" from V.V.

She claims that after defendant assistant principal Yvonne Purtille told her "she should handle it herself," her mother went to the school to complain. The only action taken, the mother and daughter say in the June 12 lawsuit, is that "Ms. Purtille was barred from contact with A.C."

Meanwhile, A.C. and V.V. were in the same auto shop class. The teacher knew that boys regularly went into the girls room, and though A.C. and other students complained to the teacher and principal about it, they did nothing to stop it, the complaint states.

On Feb. 20, 2014, V.V. forcibly raped her in the bathroom, A.C. says.

She seeks more than $1 million in punitive damages for negligence and civil rights violations.
