Stuart Davis’ Son Wants Dad’s Paintings Back

MANHATTAN (CN) - The son of American modernist Stuart Davis claims Joseph P. Carroll, a "sophisticated art merchant," illegally acquired eight of his father's paintings and may have sold some of them. Earl Davis claims Carroll got some of the pieces at bargain-basement prices from the Salander-O'Reilly Galleries, to which they had been consigned, after Salander filed for bankruptcy in November 2007.

Earl Davis claims Carroll obtained 16 of his late father's paintings improperly, some of them in 2006, and returned only eight of them.

Stuart Davis (1892-1964) was a highly regarded, jazz-influenced painter. His son demands $3 million for conversion and unjust enrichment, and the return of eight paintings.

Joseph Carroll is CEO of defendant Joseph P. Carroll Ltd.

Davis is represented in Federal Court by David Goldstein with Rabinowitz, Boudin & Standard.
