Stroke, Not Substances

The Alabama Supreme Court upheld rulings in favor of two Montgomery municipal jail employees in a wrongful death suit brought by the administrator of the estate of a woman who was arrested for DUI when she wasn’t under the influence of an intoxicating substance but was suffering from a hemorrhagic stroke. The employees are entitled to state-agent immunity, the court ruled.

MONTGOMERY, Ala. — The Alabama Supreme Court upheld a ruling in favor of two Montgomery municipal jail employees in a wrongful death suit brought by the administrator of the estate of a woman who was arrested for DUI when she wasn’t under the influence of an intoxicating substance but was suffering from a hemorrhagic stroke. The employees are entitled to state-agent immunity, the court ruled.
