(CN) - A New York man who videotaped Bernard Madoff and his wife on a yacht off Saint-Tropez in 2003 claims Fox News violated copyright by continuing to broadcast his film after getting cease and desist letters.
Kenneth Stadt, of Rockland, claims that in January Fox agreed to pay him $10,000 for the right to use his video footage for 45 days on the Fox News Channel, Fox Business Network, and the Internet.
In his federal complaint in Manhattan, Standt says he learned in March that Fox was still using the tape. He demanded that it cease and desist.
Standt says Fox acknowledged his complaint and paid him another $50,000 to extend the deal through April. But in the middle of May, Standt found that Fox was still broadcasting his tape, and he sent it another cease and desist letter.
This time, Standt says, Fox ignored him and refuses to tell him how many times the video was downloaded from its website and how much money it's made from advertisers.
Standt demands punitive damages for copyright violations and breach of the licensing agreement, and an injunction to prevent further use of the tape. He is represented by Richard Hubell.
