State Sues SoCal Hospitals for $60+ Million

LOS ANGELES (CN) - The California Labor Commissioner sued five L.A.-area hospitals, claiming they owe employees $9 million in wages, and owe the state $52 million in damages.

Labor Commissioner Julie Su sued Pacific Health Corporation et al. in Superior Court, seeking damages, liquidated damages and penalties.

According to the 28-page complaint, the following defendants owe their workers at least these amounts in wages and interest:

Pacific Health Corp.: $300,000;

Los Angeles Doctors Corporation dba Los Angeles Metropolitan Medical Center: $1.5 million;

Tustin Hospital and Medical Center dba Newport Specialty Hospital: $1.1 million;

Jupiter Bellflower Medical Center: $1.5 million;

Anaheim General Hospital: $1.3 million.

For failure to pay wages, the state seeks penalties of $100 for each initial violation, $200 for each subsequent violation, and an additional 25 percent of the unlawfully withheld wages.

For failure to pay minimum wages, the state seeks these amounts or more for the underpaid employees:

$100,000 from Pacific Health;

$600,000 from Los Angeles Doctors Corp.;

$400,000 from Tustin Hospital;

$500,000 from Jupiter Bellflower;

$400,000 from Anaheim General.

For itself, the state seeks at least these amounts in liquidated damages:

$400,000 from Pacific Health;

$5 million from Los Angeles Doctors Corp.;

$3.5 million from Tustin Hospital;

$4 million from Jupiter Bellflower;

$3.5 million from Anaheim General.

The state seeks another $1.1 million in overtime wages for employees, and another $900,000 for itself in liquidated damages, plus $5.2 million in waiting-time penalties.

It seeks another $30.5 million in civil penalties:

$1.5 million from Pacific Health;

$8.5 million from Los Angeles Doctors Corp.;

$6 million from Tustin Hospital;

$7.5 million from Jupiter Bellflower;

$7 million from Anaheim General.

Plus interest, additional damages and penalties.

The complaint does not state how long the alleged violations went on, or how the defendants allegedly got away with it.
