ST. LOUIS (CN) - A nursing home resident contracted genital herpes from nonconsensual sex while under the care of the Northview Nursing Care Center, her guardian claims in City Court.
The 50-year-old woman was incapable of turning, moving or caring for herself in any way due to a physical and mental condition, the lawsuit states. In June 2006, she was diagnosed with a spiral fracture to her right humerus that could only be caused by excessive twisting force and in August that year she was diagnosed with herpes, the claim states.
The plaintiffs seek punitive damages and are represented by Michael Walton of St. Louis.
