Son may sue father’s widow

MONTGOMERY, Ala. — The Alabama Supreme Court reversed the trial court’s grant of summary judgment to a widow and against the deceased husband’s son. The widow withdrew $282,000 over three days in 2021 as her husband began to succumb to cancer, and says the son had no legal interest in the account at the time. But the son was listed as the payable-on-death beneficiary, so his interest in the account vested at the time of his father’s death. He is therefore the proper litigant to sue the widow for unjust enrichment, fraud, conversion and theft.
