AUSTIN, Texas (CN) - A Nebraska travel agency breached a sales agreement for World Cup trips because its partner is a fan of the Mexican soccer team, the frustrated partner, Pancho Villa's Army, claims in court.
Pancho Villa's Army sued TenDot Corporate Travel, American Outlaws Inc. and TenDot employee Derrick Eells, all of Lincoln, Neb., in Travis County Court.
Pancho Villa's Army, whose mission is to support the Mexican national team, claims it had an agreement with TenDot to sell vacation packages to the World Cup in Brazil, for a commission of "$500 per package sale."
"Much to the shock and dismay of Pancho Villa, however, on August 26, 2013, TenDot terminated the agreement with Pancho Villa, citing 'information recently received,'" the complaint states.
"After several attempts by Pancho Villa to find out why the agreement with terminated, Eells finally admitted that the American Outlaws, a social group TenDot also works with that supports the United States National Football team, did not want TenDot working with a group like Pancho Villa that supports the Mexican National Football Team. TenDot decided to terminate the agreement with Pancho Villa based on the American Outlaw's threat to no longer work with Eells or his company, TenDot."
Pancho Villa's Army seeks actual and punitive damages for breach of contract, negligent misrepresentation and tortious interference with contract.
