CENTENNIAL, Colo. (CN) - The judge in accused "Batman" movie mass murderer James Holmes' trial said he would grant a delay on Holmes' second psychiatric evaluation.
Arapahoe County Court Judge Carlos Samour issued an order Tuesday granting a delay for Holmes' psychiatric evaluation until the court can take care of three motions filed last week.
"On March 14, 2013, the defendant filed Motions D-200, D-201 and D-202, which relate to Order P-68. Motion D-200 asks the Court to reconsider some of its findings and rulings; Motion D-201 seeks to strike or amend the relief granted; and Motion D-202 includes a request for clarification and alternative requests to declare a statutory provision unconstitutional and to allow counsel to attend any new sanity examination. The Court anticipated that defendant's motions would be accompanied by a request for a stay. They were not. Accordingly, the Court sua sponte stays the relief granted in Order P-68 until the defendant's motions D-200, D-201 and D-202 have been resolved."
Prosecutors requested a second evaluation last year claiming, that the first psychiatrist was biased. The doctor assigned to complete the second evaluation has been selected. His name has been redacted from court documents.
Holmes is accused of killing 12 people and injuring dozens more in the July 2012 shootings during a midnight showing of "Batman: The Dark Knight Rises."
Prosecutors indicated they will seek the death penalty.
Holmes' trial is set for Oct. 14.
