Schools Lose Appeal on Overcrowding

JEFFERSON CITY, Mo. (CN) - The Missouri Supreme Court refused to reconsider its July 16 ruling that requires school districts to accept students from other, unaccredited school districts. The students would come from the City of St. Louis Public School System and the Riverview Gardens School District in north St. Louis County, both of which are unaccredited due to poor performance and low test scores.

Other school districts in the St. Louis and St. Charles County area claimed the July ruling could overcrowd them, if they were forced to accept thousands of students from the failing districts.

The underlying case, Jane Turner v. School District of Clayton, was filed in 2007 in St. Louis County Circuit Court by a group of parents who were moving their children from the failing districts and enrolling them at Clayton. The parents argued that under state law the tuition bill for their students should be sent to the unaccredited school system. A majority of the Missouri Supreme Court judges agreed, but remanded to the circuit court "for resolution of all issues."
