ST. LOUIS (CN) - The St. Louis Public School District places a deed restriction on property it is selling that prohibits competition at taxpayers' expense, two St. Louis residents claim in Federal Court.
Rex Sinquefield and W. Bevis Shock say the district restricts property it sells so that it can't be used as a primary, elementary or secondary school of any kind for 100 years.
The plaintiffs say education entrepreneurs have been turned away from buying property because of the restriction. They say the deed restrictions violate the First and Fourteenth Amendments.
The plaintiffs say the restriction presents a substantial obstacle to anyone who wants to start a competing school and limits educational options of city children.
The plaintiffs are represented by Joshua Schindler.
The Special Administrative Board of the Transitional School District of the City of St. Louis and four individuals are named as defendants, along with the St. Louis Public School District.
