ST. LOUIS (CN) - Rock legend Chuck Berry defrauded his European booking agent in a European tour that he started late and didn't finish, the agent claims in Federal Court. Cheyenne Productions said Berry agreed to do a 12-show European tour starting in Toulouse, France on July 6, 2008 for $30,000 a show. But Berry had no intention of starting the tour on July 6 because he was being paid more to perform in Hawaii on July 4, the suit states.
Berry allegedly told Cheyenne to cancel or reschedule the first two shows. Cheyenne says it was able to reschedule the second date, but had to cancel the first. It claims Berry refused to refund the $30,000 for the canceled show, and said that unless Cheyenne paid him an additional $3,000 he wouldn't perform at all.
Cheyenne says it had no other option but to pay - but Berry wasn't finished. After performing nine of the 11 shows, Berry returned to the United States, leaving Cheyenne on the hook again, the suit states.
Cheyenne wants $93,000 for the show cancellations and the additional money Berry demanded. It also wants $70,000 in other expenses, including five first-class tickets for Berry and his entourage from London to Nice for a short vacation. It says Berry canceled the nonrefundable tickets at the airport and promised to compensate Cheyenne for them. Cheyenne also seek punitive damages. It is represented by Rhiana Luaders with Bryan Cave.
