Rockstar Misued Teen’s Bikini Pic, She Says

RIVERSIDE, Calif. (CN) - Rockstar Energy Drink did not have permission to advertise the summer comedy "The Internship" with an image of a bikini-clad 15-year-old, the teen claims in court.

The Jane Doe plaintiff sued Rockstar in Superior Court for violation of right of publicity, false light, intentional infliction of emotional distress and negligence. Her parents filed the complaint on her behalf.

In her four-page filing, the girl claims that a Rockstar employee approached her on the street in April and asked her for a photograph while she was wearing a bikini - "appropriate attire for where she was at the time."

She says she never gave the corporation permission to use her image commercially, even though Rock Star allegedly took photographs of her standing next to Rockstar logos and pop-up life size images of "The Internship" stars Vince Vaughn and Owen Wilson.

Rockstar, supposedly known for "highly-sexually-charged" ads featuring "women in bikinis in sexually suggestive poses," used the photos in a social media ad campaign for its drinks and the "The Internship," the lawsuit claims.

"Moreover, the Rockstar advertising proclaimed that Doe was an 'intern' and was 'partying,' implying illegal behavior for a 15-year-old, who in fact is an honor student in advanced AP [advanced placement] classes as a sophomore in High School," the complaint states.

The plaintiff seeks an injunction against the ads and unspecified damages.

She is represented by Peter Afrasiabi of One LLP of Newport Beach, Calif.

Rockstar did not immediately respond to an emailed request for comment.
