Rocker Sues After Backstage Fall

LOS ANGELES (CN) - The bass player for 1980s hair metal band Silent Rage says he fell off a loading dock backstage at an Oklahoma rock festival after an event organizer directed him to a "pitch black" backstage area.

E.J. Curse, whose real name is Ernest Curcio, says Oklahoma-based Pryor Creek Music Festivals invited him and his band to perform at the 2009 Rocklahoma festival, a three-year-old event that features metal and 1970s glam rock.

Curcio says he was watching the festival from the VIP section when a festival employee told him he needed to move his car. Curcio says he did.

When he got back to the concert area, the wife of Pryor Creek's director of operations, Sharon Giencke, told him to take a specific route back to the VIP section, according to the Superior Court complaint.

Giencke's directions took Curcio through a "pitch black" walkway backstage, the lawsuit states. Curcio says he made his way toward a door outlined with dim light, but in the dark, he stepped off a loading dock, falling five feet.

Curcio claims festival organizers knew about the dangerous backstage area because two other people fell off the same loading dock about 30 minutes before Curcio.

Curcio wants $75,000. He is represented by Daniel Johnson of Calabasas, Calif.
